Disability & Injury Claims

Social Security offers its insured participants a disability plan. An individual will have had to have worked five out of the last ten years, and be disabled for at least 12 consecutive months to qualify. A disability is considered a long term physical or mental condition that leaves one unable to perform work activity in the national economy. Some illnesses that cause such a disability are depression, arthritis, or back problems. We are able to take your case once a claim has been opened with Social Security. Health/Living Wills

Wills are letters to a judge telling the judge who gets your titled property, who you think should raise your children, and when you want your estate distributed. Even if you have a Trust or all your property is Joint Tenancy, you need a Will as a safety net to catch titled property that's not in the name of the Trust or that results from the prior death of your joint tenant.

Living Trusts

A Trust is like a separate personal business run by a manager called a Trustee. The rules of the business must be followed so that the people you name in the Trust get the property you specify when you tell the Trustee that this property should be delivered to them. The Trust rules can be so liberal that you may I've property to yourself as Trustee for the purpose of taking care of yourself while you live. Even though other businesses file tax returns, you may avoid filing the customary Trust Income Tax Return by reporting all income on your tax return.

A Power of Attorney document allows someone to act for you financially. There are varying degrees of power that one can designate, ranging from only being able to deposit money to having complete control of one's capitol and assets. This is useful should one be away for an extended period of time, or medically incompetent to take care of their needs.

To avoid as many problems as possible regarding your health care, you may designate a person to make medical decisions for you if you become incompetent. You may also specify what medical procedures you wish and what procedures you wish and what procedures you wish not to have. Without these protections, your rights to live or die are determined by statutes, court cases, and liability insurance companies.
